Texas Attorney General Ken Paxton Latest to Declare Daily Fantasy Sports Illegal

Texas Attorney General Ken Paxton said in their findings that are recent day-to-day fantasy sports (DFS) is just a type of online gambling and illegal in his state.

Texas Attorney General Ken Paxton (R) is in agreement with opinions issued in ny, Illinois, and Nevada that daily fantasy sports (DFS) operators have been in breach of state law and are running unlawful gambling enterprises.

In their response to a query made by Texas State Rep. Myra Crownover (R-District 64), Paxton linked the element of opportunity associated with the competitions to gambling.

‘Paid daily ‘fantasy sports’ operators claim they could legally operate … but none of existing Texas law to their arguments square,’ Paxton wrote in a statement. ‘ Because the result of games in daily fantasy sports leagues depends partially on possibility, a person’s payment of a fee to be involved in such activities is just a bet.’

Unlike his colleagues in New York and Nevada, Attorneys General Eric Schneiderman and Adam Laxalt, Paxton didn’t announce any immediate repercussions that are legal order DFS market leaders DraftKings and FanDuel to cease operations in his state. Yet.

So You’re Telling Me There Is a Chance

Paxton isn’t terribly interested in venturing to the complicated debate of deciding if daily dream contests constitute gambling or skill-based competition. That’s because in his state, perhaps the slightest component of chance overrides other factors.

‘Unlike some other states, Texas legislation only requires ‘partial opportunity’ for something to be gambling; it does perhaps not need that chance predominate,’ Paxton said.

The issue that is second has with DFS is a home is involved, much as just how gambling enterprises operate in terms of poker. The house is facilitating the game for a set fee, but not actually taking a cut of the losses in other words.

Whereas in traditional dream sports, there is no homely house, thereby causing Paxton’s belief that traditional fantasy activities leagues are not gambling, and DFS is.

If DFS operators did not simply take a cut off each individual entry fee and instead paid-out the entire pot, since many regular dream leagues do among friends, that would assist DraftKings and FanDuel’s cause. It could also make them broke.

‘Basically, it’s prohibited gambling in Texas if you bet on the performance of a participant in an event that is sporting the home takes a cut,’ Paxton said.

Texas, New York, and Illinois are all in the top five in terms of state population. Combined, the three represent nearly 19 percent of the total census in the usa, a potentially crushing blow for DFS operators should their contests be banned from every one of these states.

DraftKings and FanDuel reacted to Paxton’s statement, the former stating that the AG has a ‘fundamental misunderstanding of DFS.’ FanDuel echoed those views by asserting, ‘Today’s advisory opinion by the Attorney General of Texas is founded on a misinterpretation of the statutory law and misunderstanding for the facts about fantasy sports.’

Both platforms said they intend to continue operating lawfully in their state.

Paxton’s Next Ruling

A unlawful jury test could be in Paxton’s future, but not against DraftKings and FanDuel. Instead, the state’s top authority that is legal be defending himself on costs of securities fraudulence.

Last August, Paxton posted $35,000 bail after he was arrested for allegedly misleading investors during his work with the sector that is private becoming attorney general. The case that is ongoing go to trial sometime in 2016.

Paxton faces between five and 99 years in prison, not to mention, the relinquishment of his workplace. So DraftKings and FanDuel just need to outlast him as AG and hope the next guy possesses vision that is different.

New York On Line Poker Bill Reintroduced by State Assemblyman Gary Pretlow

New York online poker has returned to Albany, thanks to Assemblyman Gary Pretlow (D-District 89) reintroducing AB9049 to the state’s legislature. Poker may be sailing in on the backs associated with racing that is current parimutuel wagering, and breeding rules, which are also addressed in Pretlow’s bill.

The assemblyman happens to be campaigning for Internet poker since 2014, and the longtime member of the state legislature is wasting no time within the new year continuing that quest. Pretlow’s proposition declares poker become a game that is dominated by skill rather than luck, with significant taxation implications and state revenue that he states could possibly be generated from such legalization.

‘Presently, numerous brand New York residents are participating in illegal, unregulated and gaming that is unsafe which provide games of possibility online,’ Pretlow states into the proposition. ‘This bill will allow their state to permit operators that meet the high standards set by the state and offer limited games of poker which require a high level of skill.’

AB9049 would charge licensees a one-time $10 million fee and income tax revenues that are gross 15 percent.

Tough Act to Sell

But Pretlow has didn’t attract support from his peers on the 36 months he’s pushed for iPoker, and it doesn’t appear that 2016 will be any different at this juncture.

New York is one of several states currently in a hostile battle with daily fantasy sports (DFS) leaders DraftKings and FanDuel. State Attorney General Eric Schneiderman has not only declared DFS to be illegal, purchasing the platforms to shut (which both businesses experienced temporarily overruled in court), he’s also really wants to fine the operators upwards of $5,000 per violation, a punishment that may potentially complete $3 billion.

In addition to placing both businesses in bankruptcy, the penalty would also impact the numerous investors in both of these DFS companies, including NBC, Fox, Comcast, and private equity firms.

‘DraftKings and FanDuel are operating sports that are illegal sites under New York legislation, resulting in the same kinds of social and economic harms as other designs of unlawful gambling,’ Schneiderman said in November. ‘ The Attorney General’s job is to enforce New York State law, and the statutory law listed here is clear.’

Changing that gambling law, as Pretlow has undoubtedly learned by now, will be no effortless feat.

Prospective Advantages

Pretlow must recognize that passing iPoker is unlikely in New York State, with all the ongoing DFS case expected to last throughout much of the year. Enacting legislation to authorize any as a type of Internet gambling even though the state’s attorney general fights it in court appears like an extremely shot that is long.

That would be why the assemblyman returned the bill to Albany this with little fanfare week. The Racing and Wagering Committee will discuss the legislation at a hearing that is future.

Pretlow highlighted his motivation in a Roll Call op-ed summer that is last.

‘As nearby states such as nj-new jersey and Delaware have adopted well-regulated systems, they will have seen an increase that is corresponding income tax revenue,’ he wrote. ‘The security technology they have employed has not only kept gaming safe of their borders, this has developed a legal system where law enforcement can crack down on the fraud and virtually any illegal activity that currently runs rampant into the robust online black market.’

James Packer might not have given their girlfriend of 6 months, fabled singer Mariah Carey, one of their Crown Resorts being an engagement present, but he’s provided her the next thing that is best.

Packer presented the Las Vegas entertainer with a diamond that is 35-carat worth an estimated $10 million on Friday as he asked on her behalf hand.

Packer’s media, genuine estate, and gaming fortunes, stated become worth $3.5 billion as of 2015, make the band perfectly affordable for the already twice-married Packer. Neither Packer nor Carey’s divorces from their spouses that are last completely finalized yet.

As for Mariah Carey, who herself is worth a calculated $520 million, she said ‘yes.’ She also has two prior marriages under her gear, the latest to entertainer Nick Cannon, with who she has twins that are fraternal.

Running Rings Around Any Other Proposal

Carey and Packer met summer that is last attending a movie premiere in Aspen, Colorado.

‘We were talking and laughing … so we hit it well,’ Carey said of her budding love at that time.

According to celebrity insiders, the pair instantly bonded and began traveling the global world together, with photos of them relishing each other’s business aboard his yacht quickly hitting the paparrazi circuit.

The couple hasn’t announced a wedding date or location. Rumors of pre-nups also abound.

Las Las Vegas Connections

Carey has a profitable performance contract at Caesars Palace in Las Vegas. On February 2nd, she will begin the next and leg that is final of residency there, and few tickets reportedly remain for her last nine shows.

Caesars’ Colosseum, Carey’s venue, also functions as home for megastars Celine Dion (recently widowed and on hiatus until February) and Elton John when doing on the Las Vegas Strip.

Meanwhile, as a gaming tycoon, Packer is no stranger to las vegas himself. The Australian’s Alon Las Vegas property, where the brand New Frontier once endured, is slated to start in 2017. The casino that is new expected to price $4 billion.

Packer stepped down as chairman of Crown Resorts in 2015, but continues to oversee his investment that is private firm still has majority ownership in the business. The resort that is 3.5-million-square-foot be the perfect setting for what will likely be a wedding for the record books, if the couple can wait that long.

Well-known for being truly a diva and her over-the-top life style, Carey and then-husband Nick Cannon shutdown Disneyland in order to renew their wedding vows for a fourth time in 2013, so we can probably expect an extravaganza for the most recent Mrs.-Packard-to-be’s nuptials.

Third Time’s the Charm?

Carey’s first wedding to music executive Tommy Mottola lasted 5 years. At 22 years her senior, Mottola married Carey whenever she was just 23.

Her marriage that is second came years after her split from Mottola. This time it was Carey in the role that is senior as she is a decade older than Cannon. On her third go at wedding, Carey is marrying somebody finally her own age, Packer being just two years older than the superstar.

‘Once their friendship turned intimate, they have wanted to spend every moment together,’ a source told E! News. ‘with them, you can’t help but believe in real love. in the event that you invest even five mins’

Packer is hoping to give Carey, who may have produced profession performing about love, the fairytale ending the singer has so long sought. But whether effort number three for both will stick is obviously a bet we’ll see in a likely recreations book somewhere.
